Terms of Service

These Terms govern the access to and use of Enovea’s digital services for connected vehicle data, analytics, and related platform features.

1. Acceptance of the Terms

These Terms of Service (“Terms”) govern the access to and use of the Enovea platform, website, applications, APIs, dashboards, and related services (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Description of the Service

Enovea provides digital services that enable users to access, visualize, process, and analyze certain vehicle-related data through integrations with automotive manufacturers and authorized third-party data providers, including platforms such as High Mobility.

Enovea does not manufacture vehicles and does not control the source systems, APIs, or manufacturer infrastructure through which vehicle data is made available.

3. Eligibility

To use the Service, you represent and warrant that you:

  • are at least 18 years old or have legal capacity under applicable law;
  • have the right and authority to connect the relevant vehicle to the Service;
  • have obtained the vehicle owner’s authorization where you are not the owner;
  • will comply with all applicable laws, regulations, and contractual obligations.

4. Vehicle Data Access

By connecting a vehicle to Enovea, you authorize Enovea to access, retrieve, use, and display vehicle data made available through automotive manufacturers and authorized data intermediaries.

Depending on the capabilities of the manufacturer, this data may include:

  • vehicle status;
  • mileage or odometer information;
  • fuel level or battery state of charge;
  • maintenance indicators and warning signals;
  • diagnostic or technical information;
  • vehicle location data, where supported and lawfully enabled.

Data availability, granularity, and continuity depend entirely on the manufacturer and/or the third-party provider and may change, be restricted, or be discontinued at any time without notice.

5. User Responsibilities

You agree to:

  • provide accurate, complete, and current information;
  • connect only vehicles that you are legally authorized to access;
  • use the Service only for lawful and legitimate purposes;
  • maintain the confidentiality of your credentials and connected accounts;
  • promptly disconnect any vehicle that you are no longer authorized to access.

You must not:

  • attempt to reverse engineer, scrape, or compromise the Service;
  • access data from vehicles without proper authorization;
  • interfere with, disrupt, or overload the Service or connected APIs;
  • use the Service in a manner that violates manufacturer or provider terms.

6. Third-Party Services and Manufacturer Dependencies

Enovea relies on third-party providers, cloud infrastructure, and manufacturer APIs to deliver parts of the Service. These dependencies may affect functionality, availability, and data quality.

Enovea is not responsible for:

  • interruptions, outages, latency, or deprecations affecting third-party services;
  • changes in data scope, API behavior, or manufacturer access policies;
  • inaccuracies, delays, or omissions in vehicle data supplied by third parties.

7. Service Availability

The Service is provided on a reasonable-efforts basis. Enovea does not guarantee uninterrupted, error-free, or continuous availability of the Service or of any specific feature, integration, or dataset.

Maintenance operations, security interventions, manufacturer-side incidents, and infrastructure events may temporarily suspend or degrade the Service.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Enovea shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of revenue, business interruption, or losses resulting from reliance on vehicle data made available through the Service.

The Service is informational and operational in nature and does not replace vehicle inspections, professional maintenance advice, certified diagnostics, or safety-critical decision-making.

Enovea shall not be liable for vehicle malfunction, incorrect manufacturer data, connectivity issues, or decisions made by users based on the data displayed in the Service.

9. Intellectual Property

All rights, title, and interest in and to the Service, including software, content, trademarks, branding, interface elements, and documentation, remain the exclusive property of Enovea or its licensors.

Except as expressly permitted by law or by Enovea in writing, you may not copy, modify, distribute, sublicense, reproduce, or create derivative works from the Service.

10. Suspension and Termination

Enovea may suspend or terminate your access to the Service, in whole or in part, if you violate these Terms, create a legal or security risk, or if continued access is no longer technically or contractually possible.

You may stop using the Service and disconnect your vehicle(s) at any time, subject to any separate contractual commitments.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of France, without regard to conflict of law principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of [insert city], France, unless mandatory law provides otherwise.
